1.  Introduction

1.1  These user terms & conditions (the "Agreement"), which includes those terms and conditions expressly set out below and those incorporated by reference including the terms of the Privacy Policy, Rules laid down for games or tourneys or tournaments, Rules for programs brought out by the Company sch as Promotions and Offers, Refer and Earn, Bonus, etc. is an agreement between you (the "User", the “Gamer”, "you" and "your"), and Aattamania Gaming Ventures Private Limited (CIN: U58203KA2024PTC193783) and its licensors, subsidiaries, associates, affiliates and partners (the "Company", "us", "we" and "our") which governs your use of the products and services ("Services") provided by the Company through its website (www.rummypatti.in) and mobile app on Android & iOS platforms (the "Platform") and associated software ("Software"). By using any of the Services you are agreeing to all the terms of this Agreement.

1.2  If any of the terms of the Agreement are determined to be unlawful, invalid, void, or unenforceable for any reason, it shall not affect the validity and enforceability of the remaining terms. Any failure or delay on our part to act or exercise any right or remedy with respect to a breach of any of the terms of this Agreement by you shall not be construed as a waiver of our right to act with respect to the said breach or any prior, concurrent, subsequent or similar breaches.

2.  Agreement

2.1  You must ensure that you read, understand, and agree with all the terms and conditions contained in the Agreement, before you start using the Services. You should only use the Services if you have read and understood the Agreement and agree to abide by its terms and conditions.

2.2  Use of our Services or platform by You, for any reason, will be considered as you having read and agreed to the terms and conditions

2.3  We reserve the right to amend, modify, or change any of the terms of this Agreement at any time, and it is advisable to regularly look at these terms. We shall give notice of such changes ("Notice") either by notification in the manner as the Company may deem fit or by posting the amended Agreement on our Platform.

2.4  If you do not agree with the terms of the amended Agreement, you may terminate your use of the Services by notifying us that you wish to terminate your Accounts

2.5  Your continued use of the Services will be deemed to constitute your acceptance of the changes to the Agreement.

3.  Ownership

3.1  Use of the Rummy Patti (rummypatti.in) and/or Aattamania names and any of the other names or marks associated with the Platform, the Services, or the Software is strictly forbidden unless it is used with the express written permission of the Company.

3.2  The Platform, the Services, and the Software, including its code, documentation, appearance, structure, and organization is an exclusive product of the Company, which retains all rights, tangible and intangible, to the rummypatti.in website, the games therein, brand name and logo, software, codes, copies, modifications, or merged parts.

4.  Eligibility

4.1  To use our services and play free or cash games, a User must register on or platform with the mobile number and complete the KYC process by truthfully and accurately providing all the mandatory information required.

4.2  In addition, for playing cash games, a User must register for the virtual accounts in the manner as provided in detail in the below sections of this Agreement

4.3  Cash games are defined as games which are played for real money using the cash deposited in the virtual accounts of the User.

4.4  Free Games or practice games are defined as games that do not use the cash deposited (real money) in virtual accounts of the User, but are played using the free virtual chips provided to the User by the Company. These virtual chips have no real money value and are not withdrawable.

4.5  In order to participate in Cash Games, you must satisfy the following criteria at all times:

  • a.  

    You must be at least 18 years old, and must not suffer from any disability or impairment

  • b. 

    You must not suffer from any disability or impairment which would prevent you from assuming the responsibilities contained in the Agreement, or from participating in the Games which are offered as part of the Services.

  • c. 

    You must be a resident of India

  • d. 

    You must satisfy yourself that it is legal for you to participate in Cash Games in the specific jurisdiction from which you are accessing the Services.

  • e. 

    You are not a resident of any of the following states defined as "Restricted Territories"

    1. i. 

      For all Games including Free Games (practice games) and Cash Games (real money games), the States of Andhra Pradesh, Arunachal Pradesh, Assam, Nagaland, Odisha, Sikkim, Tamil Nadu and Telangana are defined as “Restricted Territories”.

    2. ii. 

      For Rummy Patti, the "Eligible Territory" for all Games including Free Games (practice games) and Cash Games (real money games) is defined as the territory of India excluding the states of Andhra Pradesh, Arunachal Pradesh, Assam, Nagaland, Odisha, Sikkim, Tamil Nadu and Telangana.

  • f. 

    You must possess a valid PAN number, Aadhaar number and savings bank account number in your name, which will be associated with your account and which you will provide to us upon request along with documents and proofs as required

  • g. 

    The Company reserves the right to require such document and/or details from the User and conduct OTP verification for the purpose verifying User identity and credentials (KYC), as may be prescribed under applicable law.

4.6  Users who do not fulfill the above criteria are expressly barred from participating in any games including cash games and free games, and would not be entitled to receive any prizes which they may win as a result of participation in such games.

4.7  You understand and accept that by viewing or using the Platform or availing of any Services, or using communication features on the Platform, you may be exposed to content posted by other Users which you may find offensive, objectionable or indecent. You may bring such content posted by other Users to our notice and we reserve the right to act upon it, at our sole discretion, as we may deem fit. The decision taken by us in this regard shall be final and binding on you.

4.8  The user agrees and acknowledges that he/she can only access or platform or services and the game from territories that are not classified as Restricted Territories. Any access to our website or mobile application by the user from a Restricted Territory through the usage of Fake IP or GPS masking software such as Fake GPS location, Fake GPS GO Location Spoofer, VPN, etc. will amount to a breach of our terms and conditions. This will lead to permanent blacklisting, deletion/suspension/termination of the Username and closure of Accounts and also forfeiture of the entire Cash Balance, without any prior notice to the User. Further, such actions are also a breach of applicable laws for which the User shall be solely liable to penalties (monetary and penal) under applicable laws. The Company is not responsible for the consequences on the User for illegally accessing our platforms by breaching our security protocol.

4.9  You agree and acknowledge that you have not been convicted for any crime. You agree and acknowledge that you are not on the UN Sanctions list or work for a company that is on the UN sanctions list.

5.  Description of Services

5.1  We provide valid, registered Users the opportunity to access or platform and use our services to play games, including free games and skill-based cash games of Rummy Patti and its variations. The Company provides software and IT services to enable games of skill to be played with other individuals over the internet

5.2  The Services provided by the Company are only intended to facilitate games of skill.

5.3  The Company levies a charge ("Service Charge" or “Platform Fees”) for Cash Games from all the users who participated in said cash games. The Service Charge may vary from time to time and from one cash game to another and will be deducted from the entry fees paid by the Users to participate in cash games

6.  Know Your Customer (KYC)

6.1  You are required to verify your personal identity and credentials as required by law and the Company in order to gain continued access to our Platform and Services.

6.2  You undertake that all the information provided by you at the time of opening the Accounts, or provided by you subsequently upon request by the Company, is true, complete and correct.

6.3  You are further required to provide proof relating to any such information, including copies of documents such as your PAN card, AADHAAR or address and identity proof, Bank account, etc upon request by the Company.

6.4  You understand that the Company may take steps to verify any such information provided by you. The Company may use the services of third-party vendors in order to verify your information from time to time.

6.5  Your continued use of the Services, including but not limited to your ability to make deposits and Cash Withdrawals in accordance with the terms of this Agreement, is subject to the Company's continued satisfaction that all such details provided by you are true, complete and correct

7.  Goods and Services Tax

7.1  You acknowledge and agree that in compliance with the Central Goods and Service Tax Act' 2017 and Integrated Goods and Service Tax Act' 2017 effective from 1st October' 2023, and the rules framed thereunder, the Company will charge and collect goods and service tax ("GST") on the deposit (purchase) made by you on our Platform, at the rate of 28% or such other rate as may from time to time be prescribed under the applicable law.

7.2  The amount deposited by you on the Platform will be inclusive of GST and the actual amount credited to your deposits account will be net of GST. The GST collected from you will be remitted to the appropriate authorities

7.3  In addition to this, you further agree that you will be solely liable for any other indirect taxes levied on the deposit or playing of any game as per applicable law / judicial pronouncement. We reserve the right to recover such indirect taxes from you and remit the same to the appropriate authorities

7.4  Tax Invoices for the deposits made on the Platform, including details of the GST charged shall be available for users to download through the wallet section on the Platform

8.  User’s Account

8.1  Each User's account shall be deemed to be compartmentalized into three virtual accounts (collectively, the "Accounts").

  • a. 

    All cash deposits made by the Users for playing any cash game through the mechanism as set out in sections below shall reside in the “Deposit Account” (first virtual account)

  • b. 

    Any Bonus Amounts received by the User in accordance with Promotions and Offers of the Company (explained in sections below of this agreement) shall reside in the “Bonus Account” (second virtual account), and

  • c. 

    Any winnings in cash games that the User wins, shall reside in the “Winnings Account” (third virtual account).

  • d. 

    Your updated Cash Balance shall be duly reflected on the Platform in the Wallet section.

8.2  Your Accounts are to be used and accessed solely by you. You are prohibited from using the Services by means of Accounts registered in the name of any other individual.

8.3  Should you attempt to open more than one Accounts, under your own name or under any other name, or should you attempt to use the Services by means of any other person's Accounts, we reserve the right to close all your Accounts and bar you from accessing or using the Services in the future without notice.

8.4  The Company reserves the right to monitor any effort to establish multiple accounts; in the event the Company discovers that you have opened more than one account per person, we are entitled to termination of all of your accounts and the Company may void any associated winnings

8.5  You shall not share the password to your Accounts, or any other confidential or sensitive information associated with your Accounts, with any other individual. The Company is not responsible if your Accounts are accessed by others using your password or other confidential details or information. The Company assumes your responsibility in taking appropriate steps to select and secure your passwords by recommending to have a strong password.

8.6  You understand, represent and accept that your Accounts information or any related materials will not violate the rights of any third-party rights or give rise to any claim that another party's rights have been or will be violated as a result of the Company's use or publication of your Accounts information. You also understand that you will not be entitled to receive any royalties for the use of your Accounts information by or through the Company.

9.  Deposits Account

9.1  In order to participate in Cash Games, you are required to maintain a positive cash balance ("Cash Balance") in your Deposit Account. The Company may set minimum cash balance limits or minimum deposit limits from time to time

9.2  In relation to such Cash Balance, you undertake/ understand the following:

  • a. 

    All credits/deposits to your Deposits Account made by you must be through the thirdparty payment gateway(s) made available on the Platform by the Company. The Company is not responsible for authorization/denial of any such transactions, and such transactions are subject to and must be undertaken in accordance with the terms and conditions specified by such third-party payment gateways.

  • b. 

    We are not responsible for delays or denials at their end and processing of payments will be solely in terms of their policies and procedures without any responsibility, liability or risk at our end. If there are any issues in connection with adding cash, a complaint may be sent to us following the complaints procedure provided in "Complaints and disputes" section below. You agree that in such an event of your credit being delayed or eventually declined for reasons beyond our control, we will not be held liable in any manner whatsoever.

  • c. 

    The Company may however reverse any transaction, in which case the relevant amount would be refunded to the instrument/account which was used to perform the transaction.

  • d. 

    It is further agreed and acknowledged by the Users that all credits/deposits in the Deposits Account shall at all times be held by the Company in trust, for and on behalf of the respective Users till such amount is deducted from the Deposits Account, to enable the Users to participate and play the cash games

9.3  All deposits must be through instruments/accounts which belong to you and are in your name.

9.4  All transactions on the Platform must be conducted in Indian Rupees.

9.5  The amount thus deposited by the User will get credited to the User’s deposit account upon successful completion of the transaction, subject to deduction of Goods & Service Tax, and any other direct or indirect tax levied by the Government from time to time

10.  Bonus Account

10.1  Any bonus amount that the User is eligible for as per the ongoing promotions and offers shall be credited exclusively to the bonus account.

10.2  The promotions and offers may vary from time to time and the User will be eligible for the promotions and offers in place at the time of the event or purchase. The Users are required to read the section on promotions and offers in detail before making any purchase or taking action.

10.3  It is further clarified that the bonus amount can only be used to avail discount on entry fees of cash games or tourneys that User is required to pay to play the cash game and is not withdrawable.

10.4  The rate of discount may vary for each cash game or tourney and will be decided by the Company and automatically deducted from the bonus account at the time of the User paying the entry fees.

11.  Winnings Account

11.1  Any winnings in Cash Games played by the User will be credited exclusively to the winnings account.

11.2  The calculation of winnings that are to be credited to winnings account shall depend on the rules, terms and conditions of each cash game or tourney or tournament and may vary from one cash game to another

11.3  The winnings that will get credited to your winnings account shall mean the prize money won as per the rules, terms and conditions of that game or tourney or tournament (as shown at the time Commented [PS4]: Should be hyperlinked Commented [PS5]: Should be hyperlinked of registering for the game and prorated based on actual participation), reduced by the amount used to pay entry fees from the deposit account and any platform fees or service charges levied by the Company.

11.4  The Prize Money or winnings may be prorated based on the actual participation in the cash game or tourney or tournament. You are required to check the rules and terms and conditions of each game before participating in the same.

11.5  The winnings can only be withdrawn in accordance with the terms of withdrawal mentioned in this agreement

11.6  You understand and accept that your participation in a Game does not create any obligation on the Company to give you a prize. Your winning is entirely dependent on your skill as a player visa-vis other players in the Game.

11.7  The Users agree and acknowledge that the Company shall facilitate to collect and receive the winning amount from the other participants in the cash game and transfer to the winner. The Company shall hold the same in the winnings account, in trust for and on behalf of the winner until such time as the User may decide to withdraw the same, in accordance with the terms and conditions of this Agreement.

11.8  A cash amount corresponding to the aggregate of the amounts in accounts of all Users is maintained in an unencumbered and separate bank account(s) by the Company at all times, separate from other funds of the Company. Such cash balances are available to either be played to the extent of amount lying in the deposits account or be withdrawn to the extent of amount lying in winnings account at any time by Users, subject to specific restrictions contained in the Agreement.

11.9  The Company may impose daily/per-session limits, or other types of limits, upon your ability to perform deposits or cash withdrawals, in order to encourage responsible play as well as to prevent unauthorized or illegal activity. You will be informed of such limits at the time when they are imposed, and will also be informed of any change to such limits. While you may request that such limits be modified, the Company reserves the right to impose and modify such limits using its sole discretion.

12.  Withdrawal of Winnings

12.1  Any withdrawal of cash from your Accounts ("Cash Withdrawal") may be carried out only in accordance with the terms of this Agreement. Cash Withdrawal can be carried out only from the winnings account and not from deposits account or bonus account.

12.2  To the extent permitted by law, the claims of Users over amounts corresponding to their cash balances will be given preference over all other claims.

12.3  User's relevant details required for the processing of payment from the Company to the User's account will be shared with our payment partners.

12.4  Cash Withdrawals may be requested by you at any time, subject to any limits which have been imposed and in accordance with the terms and conditions of this Agreement.

12.5  Cash withdrawals cannot be made by you to a bank account that is located in a Restricted Territory

12.6  Any cash withdrawal shall be affected by the Company by way of bank transfer to your bank account. Your preference in this regard will be given due consideration.

12.7  Please note that any cash withdrawal will be affected by the Company only in favour of an Indian Rupee account in your name.

12.8  KYC verification is mandatory as a proof of identity for making withdrawals from your winnings account to your bank account. KYC verification may be done through the Platform by providing certain details like Aadhaar, PAN, Bank account and any other User details as required by law.

12.9  Updating and verifying PAN and Bank account successfully are mandatory for any cash withdrawals.

12.10  The Company is under no obligation to allow any cash withdrawal if the User has not completed the KYC, PAN, Bank account and any other verification as required by law, to the continued satisfaction of the Company.

12.11  In case the User does not verify their PAN successfully, at the end of the financial year, the Company will remit the TDS deducted from the User thus far to the Government on a No Name basis.

12.12  The Cash Balance does not carry any interest. The Cash Balance is not transferable or negotiable, except to the extent as may be expressly permitted by the Agreement.

12.3  Further, no Cash Withdrawal will be allowed from the Cash Balance associated with the Accounts of each User, unless the relevant User has played sufficient number of Cash Games (which may be determined solely by the Company in its discretion and revised from time to time) subsequent to the last recorded cash credit.

12.14  Except in case of permanent closure of User account, no cash withdrawal would be permitted from the deposits account.

12.15  When the respective User chooses to withdraw such winnings from the winnings account, the Company on receipt of the request in the specified form will transfer the specified amount to the Users, subject to Tax Deduction at Source (TDS) at the rate of 30% on Net Winnings, or any rate as prescribed by the Government from time to time

12.16  You understand that the Company is mandated to deduct TDS at the time of cash withdrawal by the User in compliance with the applicable laws.

12.17  Any cash withdrawal, as requested by the User, will be processed and paid out to the User’s bank account, subject to the terms of this agreement, within 3 to 4 business days.

  • a. 

    Your winnings in a tourney shall be subject to internal checks (including fraud checks) as per our policies and shall be released to your Account after all checks are cleared, within a reasonable time. In case you are found to be involved in any fraudulent activity in any game or tourney, the Company shall have the right to deduct your winnings of the said tourney and/or impose a penalty or fine as it deems fit. The Company retains the sole right to determine what constitutes fraudulent activity, and its decision in such matters shall be final and binding

  • b. 

    There may be delays at times on account of such checks, but the Company will process the requests at the earliest. The User may raise a support ticket in cases of unreasonable delays and the Company will resolve the same at the earliest.

12.18  The Company cannot be held accountable for delays on account of delays at the receiving bank’s end.

12.19  The Company may tie up with third party payment gateways to enable instant withdrawals of cash from winnings account. However, the User understands that this is in accordance with the terms and conditions of the payment gateway and any service charges applied by the payment gateway will be borne by the User.

13.  Withdrawal from Deposit Account

13.1  While your winnings amount can be withdrawn from the winnings account, the cash balance in the deposit account can only be withdrawn in case of permanent closure of your account with the Company.

  • a. 

    In such cases, the balance in the deposit account will be processed and paid out to the User net of any taxes applicable

  • b. 

    The Company may also apply a service charge on the User and deduct the same before paying out the deposit balance to the User

13.2  It is hereby clarified that sch withdrawals are possible only upon the successful verification of your KYC documents, PAN details and bank account, failing which we will not be obligated to process any requests.

13.3  You shall ensure that your name is identical in your KYC documents, PAN and bank account, failing which we will not be obligated to process any requests.

14.  Rummy Patti Gaming Modes

Rummy Patti will be made available on our platform in multiple game modes including free gaming mode, real money gaming mode and real money tournament mode or other modes published periodically. Each gaming mode will have its own rules and regulations and terms which will be made available to you on our platform. You agree to abide by the rules and regulations of each of the games or gaming modes. You should ensure that you have read and understood the rules and regulations and any other terms of the games. These game rules form part of the agreement and can be found on the 'Rummy Patti gaming modes' page of the platform.

Please read them now before using the Services. We may, from time to time, make additional game formats available as part of the Services, or make changes to the rules and regulations or terms of the existing game modes. This agreement will apply to any game rules relating to such game formats. We will let you know about, and give you the opportunity to read, such game rules at the time of introducing additional games to the platform. We reserve the right to determine the results and winners of each of the games in accordance with the game rules.

By registering and/or participating in any game or tournament you agree by these determinations. We will publish the list of winners after each game on the Platform.

15.  Splitting of Prize Money

15.1  In certain scenarios, where Users are tied at the same spot in any free or cash game or tournament , the position and the Prize Money will be shared amongst the Users subject to the rules, terms and conditions of that game or tourney.

15.2  This will be done in accordance with the Game rules and rules of respective game modes mentioned on or platform and can vary from game to game. We reserve the right to amend, modify or change the rules for automatic splitting of the Prize Pool at any time without prior notice to the User.

15.3  By registering and/or participating in any real money cash game or Tourney you agree to these Rules for automatic splitting of the Prize Pool.

15.4  You acknowledge and agree that the decision of the Company in case of any dispute regarding winning & disbursement of prizes shall be final and binding on you.

16.  Promotions and Offers

16.1  The Company may come up with various promotions and offers from time to time. These promotions are intended to motivate or reward the Users for carrying out certain actions or purchases on our platform

16.2  Bonuses are a key part of or promotions program and there are various types of bonuses offered to the Users.

16.3  These bonuses come with a validity period and it is usually 365 days from the date of grant post which the bonus expires

16.4  The actual validity of each bonus award may vary from time to time and hence it is important that the user reads the terms and conditions of that particular bonus award before agreeing to the terms and using it.

16.5  Users cannot claim a right to these bonuses and the Company retains the right to revoke or discontinue the bonus programs, including the remaining bons balances in the User accounts at any time with or without notice.

16.6  In case of any requests or disputes, the Company will review the same in a fair manner before taking a decision. The decision of the company will be final and binding in all cases.

17.  User Restrictions

17.1  You undertake that you will play the game yourself in a fair manner without taking any external assistance or colluding with other gamers in any form or use unauthorized components, bots, cheat codes, hacks, etc. If we identify any form of cheating or collusion or any other unfair or unlawful action, we reserve the right to take appropriate action including permanent closure of account, levying penalty or fines on the gamer as the Company deems fit, and take appropriate legal action

17.2  You are prohibited from doing any activity on or platform which may be construed as money laundering

17.3  You are strictly prohibited from sending spam messages or communication to other Gamers or on our platform.

17.4  You are also strictly prohibited form sending any communication or creating User ids that can be considered as defamatory, obscene, abusive, illegal, contains expressions of hate, hurting religious sentiments, racist, sexist, intruding privacy, violates intellectual property, commercial or promotional in nature, etc

17.5  You shall not upload, distribute or publish through the Portal, any content which may contain viruses or computer contaminants (as defined in the Information Technology Act 2000 or such other laws in force in India at the relevant time) which may interrupt, destroy, limit the functionality or disrupt any software, hardware or other equipment belonging to us or that aids in providing the services offered by us

17.6  Any form of fraudulent activity including, attempting to use or using any other person's UPI, credit card(s), debit cards, net-banking usernames, passwords, authorization codes, prepaid cash cards, mobile phones for adding cash to your user account is strictly prohibited.

17.7  Accessing or attempting to access the Services through someone else's user account is strictly prohibited. Winnings, bonuses and prizes are unique to the player and are non-transferable. In the event you attempt to transfer any winnings, bonuses or prizes, these will be forfeited.

17.8  You shall not host, intercept, emulate or redirect proprietary communication protocols, used by the Portal, if any, regardless of the method used, including protocol emulation, reverse engineering or modification of the Portal or any files that are part of the Portal.

17.9  You shall not accuse or hold us or the Portal accountable for any false claims or illegal actions/inactions that are not solely attributable to us. You may not impose editorial comments, commercial material or any information on the Websites, alter or modify Content on the Portal, or remove, obliterate or obstruct any proprietary notices or labels

18.  Modification of Terms and Conditions

18.1  We may alter or modify the Terms at any time with or without giving prior notice to you. We may choose to notify changes in the Terms either by email or by displaying a message on the Portal; however, our notification of any change shall not waive your obligation to keep yourself updated about the changes in the Terms. Your continued use of any Portal and/or any Services offered constitutes your unconditional acceptance of the modified or amended Terms, immediately upon the modification or amendment of such terms

19.  Governing Law and Jurisdiction

19.1  The Terms shall be governed and interpreted by, and construed in accordance with the laws of India. All disputes, differences, complaints etc., shall be subject to arbitration under the (Indian) Arbitration and Conciliation Act, 1996 as amended from time to time. The place of arbitration shall be Bengaluru, India and the language of arbitration shall be English. Arbitration shall be conducted by a sole arbitrator to be appointed by the Company and the concerned Player.

19.2  Subject to the arbitration agreement above, all disputes, complaints, differences, etc. shall be subject to the exclusive jurisdiction of the courts at Bengaluru, India

20.  Limitation of Liability and Indemnity

20.1  The Company shall not be liable for any claim, loss, injury, or damages (direct, indirect, incidental or any other kind whatsoever) arising from or in connection with your use of our Services, the Platform or the Software.

20.2  Notwithstanding anything to the contrary contained in the Agreement, you agree that our maximum aggregate liability for all your claims against us, in all circumstances other than for valid Redemption of any Cash Balance in your Accounts shall be limited to Rs. 1,000/- only

20.3  You agree to indemnify and hold harmless the Company against any claims, actions, suits, damages, penalties, or awards brought against us by any entity or individual in connection with or in respect of your use of the Services, the Platform or the Software.

20.4  If you have an issue within a particular game (which shall bear a specific game ID), you are entitled to report such issue to the Company within 30 days from the date you played such game (in which you faced the issue). The Company will not entertain, act upon or follow up on complaints specifically relating to issues reported by you beyond 30 days from the date on which you played the concerned game.

21.  Disclaimer

21.1  The Services on our Portal and the Content present on it are provided strictly on "as is" basis with all faults or failings. Any representations, warranties, conditions or guarantee whatsoever, express or implied (including, without limitation, any implied warranty of accuracy, completeness, uninterrupted provision, quality, merchantability, fitness for a particular purpose or non-infringement) are specifically excluded to the fullest extent permitted by law.

21.2  The Company disclaims all warranties, express and implied with regard to the merchantability and fitness for a particular purpose, non-infringement, freedom from computer virus etc of the Platform, the Services or the Software. The Company does not represent or warrant that the functions contained in the Platform, the Services or the Software will be uninterrupted or error-free, that defects will be corrected, or the company or the server that hosts the platform, the Services or the Software available are free of viruses or other harmful components. You may access our Platform at your own volition, risk and consequences. We are not responsible or liable for any loss or damage (including injuries, death, or loss of property) that you or any third parties may suffer while accessing our Platform.

21.3  Additionally, The Company also reserves the right to limit your use of the Services or participation in any Game, or terminate your Account, in case it determines that you have intentionally caused any malfunction or disruption of the Services. [The Company is not liable for any potential winnings from any unfinished Cash Games.]

21.4  The Company disclaims responsibility and liability for any harm resulting from cancellation of any Game organized by it. You acknowledge and agree that you will not be entitled to any refund in case of any service outages that may be caused by failures of our service providers, computer viruses or contaminants, natural disasters, war, civil disturbance, or any other cause beyond our reasonable control. The Company specifically disclaims any liability in connection with Games or events made available or organized on the Portal which may require specific statutory permissions, in the event such permissions are denied or cancelled whether prior to or during such Game or event.

21.5  The Company specifically disclaims any liability in connection with your transactions with third parties which may have advertisements or are hyperlinked on the Portal. The Company disclaims any liability in connection with violation of intellectual property rights of any party with respect to third party Content or user content posted on our Website/App. Intellectual property rights in any Content not belonging to us belong to the respective owners and any claims related to such content must be directly addressed to the respective owners.

21.6  The Company specifically disclaims any liability arising out of the acts or omissions of the infrastructure providers or otherwise failure of internet services used for providing and accessing the Services. We disclaim liability for any risk or loss resulting to you from your participation in Cash Games, including all risk of financial loss.

21.7  The Company will not be liable or responsible for (i) any issues relating to storage, delivery, deletion or accessibility of information or materials to the extent permitted under law, (ii) errors or inaccuracies in the Game provided on our Platform, (iii) inaccuracies in calculating Game points or the selection of winners and even due to inaccurate or incomplete information received from any third-party service provider, (iv) any errors relating to communication, or omissions in communication, including any errors you make, which may prevent/hamper the results from being communicated to you, (v) for any consequences relating to your sharing any confidential information including but not limited to one time passwords (OTP) with any other person or third parties. The Terms shall be subject to this Disclaimer.

23.  SMS Alerts

23.1  The Company requires to send you SMS messages from time to time for essential services like registration, mobile verification, KYC, etc. By signing p and registering on or platform, you are providing consent and opting in for or SMS alerts program. Please note that these are not SPAM messages.

23.2  If you wish to opt out of the SMS alerts program at any point of time, you can do so by turning off the SMS alerts option on or platform. Please note that by turning off the SMS alerts option, you may not receive important information from the Company or may not be able to se the services of the Company any longer.

23.3  While the SMS services of the Company are complimentary, data and message rates may apply and may be charged by your telecom carrier or internet service provider depending on your plan.

24.  User Account Closure Policy

24.1  In case any User wants to permanently close their User account with the Company, they can do so by writing to us at support@rummypatti.in

24.2  The Company will then take appropriate action to close the account within the next 15 days. Any redeemable cash balances remaining in the User’s account like cash deposits balance and winnings balance will be paid out to the User subject to tax deductions and any other permissible deductions by law.

24.3  The Company will also levy a service charge of 10% on the remaining deposit balance at the time of permanent closure of the account as fees towards expenses incurred in support and maintenance of the platform and other expenses incurred by the Company.

24.4  In case there are any ongoing checks or investigations happening on the User’s account, then the account closure will be put on hold until the investigations are closed and the findings are acted upon.

24.5  On closure of the User account, any bonus amount remaining in the bonus account will be made void. Bonus amounts are not withdrawable and cannot be converted to cash.

25.  Service Disruptions and Cancellation

25.1  There may be times when the User faces service disruptions at their end due to internet disconnection or weak internet bandwidth or any other issues.

  • a. 

    You understand that it is completely your responsibility to ensure you access our platforms from places and devices that support strong and reliable internet connection and does not case any disruptions. The Company is not responsible for any disruptions at the User’s end

  • b. 

    However, some of the game modes may support the User in case of a temporary disruptions by making a single play (single move) for the User when they are disconnected. If the User manages to join back the game before the next turn, then they can continue playing. Else, they are removed from the game and will not be able to play that particular game any longer. The User’s are required to read up on the different game modes for more details on the same.

  • c. 

    In any case, if the User is disconnected from the game at any stage of the game play, then they will not be eligible for any refund of their entry fees.

  • d. 

    Some game modes or tourneys or tournaments may consider the User for prizes based on their position at the time of exit. However, Users should note that they are not entitled to prizes in such cases and the Company’s decision on winning position and applicability of prize money will be final and binding.

25.2  There may also be scenarios when a game is disrupted due to any unforeseen issues or technical glitches at the Company’s end.

  • a. 

    In such cases, the Company will cancel any game that is ongoing and will refund the entry fee paid by the Users for that game back to the source account

26.  Idle Accounts

26.1  In the event that, for a period more than 30 days, you (i) maintain a balance in your bonus account and (ii) fail to participate in a Cash Game, the Company, in its sole discretion, reserves the right to deduct with the entire amount in the Bonus Account or otherwise deal with such amount as it deems fit

26.2  In the event that, for a period of more than 360 days, you (i) maintain a Cash Balance in your deposit account and (ii) fail to participate in a Cash Game, the Company, in its sole discretion, reserves the right to deduct the entire amount in the Deposits Account or otherwise deal with such amount as it deems fit.

26.3  Further the Company shall refund the entire amount in the Winnings Account (lying more than 360 days) to your bank account available with us. In case of non-availability of your bank account details, the Company may require you to provide those details to process the refund. In case of non-submission of bank account details within scheduled time, the Company, in its sole discretion, reserves the right to deduct the amount in the Winnings Account or otherwise deal with such amount as it deems fit.

26.4  In case of forfeiture, the amount forfeited by the Company shall be considered as gross amount charged which is inclusive of Goods and Service Tax (GST) as may be applicable. These requirements and provisions may be modified from time to time in accordance with changes to the relevant tax and other laws.

27.  Refunds

In some special circumstances, the Company may allow and process refunds at its sole discretion. The circumstances are listed below.

  • 27.1 

    Erroneous transactions: In case of deposits made by accident or erroneously in to your deposit wallet, you may request for a refund within one week from the date of such erroneous transaction taking place. The Company after determining in its sole discretion if the request is genuine, and if the User has the required deposit balance unutilized in their account, may process the request and refund the amount to the User within two weeks.

    1. a.  The refund will be made only to the instrument which was sed to make the deposit and not other modes will be accepted.
    2. b.  Any GST or other statutory deductions made on the deposit will be paid out to the appropriate authorities and the same shall not be refunded to the User.

27.2  Fraudulent transactions: In case of any fraudulent transactions where a deposit was not authorized by you and the amount was deposited to another User’s account, then you may raise a request for refund with the Company within one week of such fraudulent transaction taking place. The Company after determining at its sole discretion if the request is genuine, will take the following action

    1. a.  If the amount remains unutilized in the other User’s account, then the request will be processed and refunded in two weeks time.
    2. b.  However, if the deposit amount has been utilized by the other User already, then the Company shall not be able to process any refund in this case. However, the Company shall extend its cooperation to the banks or other appropriate authorities by providing details of the transaction and the details of the User in to whose account the deposit was made.
    3. c.  The refund will be made only to the instrument which was sed to make the deposit and not other modes will be accepted.
    4. d.  Any GST or other statutory deductions made on the deposit will be paid out to the appropriate authorities and the same shall not be refunded to the User.
28.  Complaints and Grievances

Users are encouraged to reach out to us on any complaints, concerns, grievances or feedback that they may have by writing to us at support@rummypatti.in. We will review and try to address or resolve your grievances within 10 business days of receiving the complaint. In case of any reasonable delays, the Company will make all attempts to keep you informed and resolve the issue at the earliest.

28.1  You agree to raise any complaint or grievance within 10 business days of the incident or the issue arising. We are not obligated to address any concerns in case of any delay in raising the concern.

28.2  The Company will review and address all concerns in a fair manner as quickly as possible. The Company’s decision on the concern will remain final and binding

28.3  You agree to keep all details regarding the concern and its resolution confidential and not disclose to any third party

29.  Additional Charges

Certain additional charges may be levied upon you by the Company, or by payment gateways, banks or other intermediaries, at the time of making deposits and Cash Withdrawals. You agree to pay any such additional charges, which may vary between various banks, payment processors or other intermediaries.
